Port Authority of Allegheny County d/b/a Pittsburgh Regional Transit (“PRT”) Ready2Ride Mobile and Account Based Ticketing (“MABT”) User Terms and Conditions (“Terms and Conditions”)

I.       DEFINITIONS AND REQUIRED ACCEPTANCE OF TERMS

AND CONDITIONS

ReadyFare™ refers to the various tickets, passes, and fare cards, in paper/plastic and electronic forms, that bus, rail, and incline passengers may use to travel on PRT’s fixed route public transit system.

Ready2Ride® is a mobile ticketing application (the “App”) owned by PRT, with MABT sales provided by Masabi LLC (“Masabi”), that specifically enables the purchase and use of electronic ReadyFare™ options as further described herein. The App is protected by United States and international copyright, trademark laws, and other laws. Unauthorized use may violate such copyright, trademark, or other laws.

These Terms and Conditions constitute your Ready2Ride® Agreement and will govern the access to and use of the App to pay your fares for fixed route bus, light rail, or incline transit services provided by PRT (including incline services on the Duquesne Incline, which is operated by the Society for the Preservation of the Duquesne Heights Incline) (collectively the “PRT Services”). By downloading and/or using the App, you agree to these Terms and Conditions, and you are responsible for reviewing and ensuring that you are familiar with and understand these Terms and Conditions. 

PRT may modify these Terms and Conditions at any time by posting revised Terms and Conditions on PRT’s website at www.rideprt.org and at PRT’s Downtown Service Center location. Notice of updates to these Terms and Conditions will also be provided to App users on PRT’s website. This will not affect any existing terms accepted by you during any earlier use of the App. You are responsible for ensuring that you remain up to date on any changes to these Terms and Conditions, and your continued use of the App will serve as your agreement to any such changes to these Terms and Conditions.

Your downloading and/or use of the App at any time and in any manner is subject to these Terms and Conditions. 

II.     RIGHTS UNDER THE APP

Pursuant to these Terms and Conditions and your responsibility to remain knowledgeable of and continuing to accept same, PRT grants you the right to download, install, and use the App on an eligible mobile device and enables you to make payments and access information in accordance with the terms set forth herein.

Once you have downloaded the App, you will have a variety of electronic ReadyFare™ options to choose from. You can:

·        Purchase mobile tickets (including full day, 7-day, 31-day, or annual passes) (any or all of these options will be collectively referred to hereinafter as “Tickets”) for PRT Services; and/or

·        Use it in conjunction with a token to pre-pay for PRT Services.  A token is a type of fare media, such as your mobile device or a ReadyFare™ Card (each hereinafter, a “Token”), that identifies an account assigned to you (an “Account”) and authenticates that you have pre-paid funds (“Stored Value”) (as further defined in Section III(B) herein) available to pay the fare for the use of PRT Services.  Adding Stored Value in the App requires the creation of an Account.  Once you have created an Account through the App, you can add Stored Value to use for PRT Services on your mobile device or link your Stored Value directly to an external physical Token (e.g., a ReadyFare™ Card) to pay your fare(s). 

You do not and will not own the App or any information that is provided to you through it or PRT or PRT’s contractors or consultants, but you may use the App in accordance with these Terms and Conditions solely for the purposes of purchasing, storing, and using Tickets and/or Stored Value and accessing transport information for your own personal use and not for any other purpose. You must not try to alter, modify, or in any way try to copy or transfer a purchased Ticket or Stored Value to any other user(s).

The App is provided to you, at this time, free of charge. PRT can suspend access to your ability to purchase Tickets or to use Tokens through the App and can do so for any reason.

You must ensure that your mobile device has the required version of the relevant operating system to support the App. You are responsible for all operating system updates and data charges incurred when using the App with your mobile device(s) and mobile device service provider(s).

III.              USE OF MOBILE TICKETS AND TOKENS

A.    Purchase and Use of Tickets

Tickets for PRT Services are available to purchase via your mobile device(s) using the App. Once you have purchased a Ticket, it will be delivered directly to your designated mobile device and be available immediately for travel. Tickets sold on the App are for use on PRT Services only in the times and in the areas as specified at the time of purchase.

When you purchase a Ticket on the App, you will be notified of the price before you confirm your purchase. The price you pay for the Tickets will be valid for the duration on the Ticket purchased, and any subsequent price changes during the validity of the Ticket will not affect it.  A purchase receipt will be emailed to the address entered at the time of purchase or to the one on record for any registered Account(s).

To purchase reduced fare Tickets on the App, you must be eligible for reduced fares.  For more information on reduced fares, please visit www.rideprt.org, click the “Fares” tab, and then click the “Discounted Fares” tab or contact PRT’s Customer Service Department during its normal operating hours at 412.442.2000.

PLEASE NOTE that the ability to register for and purchase a half-fare Ticket on the App is provided through PRT’s Downtown Service Center. If a customer chooses to use the App for the purchase and use of half fare Tickets and already has a Half Fare ReadyFare™ Card, the user’s Half Fare ReadyFare™ Card will be deactivated through the Service Center and replaced in the App with half fare eligibility activated.  Eligible customers can only have one type of half fare Token activated at any one period of time.

For Tickets purchased with a credit or debit card, the appropriate payment for the Ticket duration you select will be deducted from your bank account at time of purchase.  (Please note that if you make Ticket purchases via your credit or debit card, you may choose to store debit/credit card information in the App for future transactions.)  

Tickets must be activated prior to you boarding the bus, light rail vehicle, or incline. Please ensure you have sufficient battery charge on your mobile device to display and/or validate your Ticket via an onboard validation device and for the whole duration of your journey.  PRT does not accept any liability for any loss you may incur in the event that you do not have sufficient battery life on your mobile device and/or if your mobile device is malfunctioning in any manner.

Please also allow time for the App to load while waiting for the bus, light rail vehicle, or incline. If you are unable to display the Ticket on your mobile device, the full cash fare must be paid, and no refund will be available from PRT.

PRT reserves the right to refuse travel for an invalid Ticket or if the Ticket is used on a stolen mobile device. Tickets are nontransferable.  Additionally, purchasing Tickets does not give you priority to use PRT Services over other passengers; PRT Services remain subject at all times to PRT’s vehicle capacity and service capacity.

The security of your mobile device or Ticket is your responsibility. In the event that the Ticket or your mobile device is lost or stolen, PRT will not provide a duplicate or replacement Ticket.

Your Ticket barcode must be displayed clearly on the mobile device screen to the operator every time you board a PRT bus, or when requested by a designated PRT vehicle operator, Port Authority Police Officer, and/or other designated PRT employees to view it. The Ticket must be retained during your entire trip on a PRT vehicle.

If the Ticket has been damaged or is not readable in any way, it becomes invalid, and you must pay your fare in another way. If you delete the App, you will also delete your Tickets. If you reinstall the App on the same device it was deleted, your Tickets will be downloaded to the device. You cannot print or transfer Tickets to another user.  Please also note that to be able to use the App, you may only change mobile devices three (3) times in a six-month period.

Tickets will expire once a Ticket validity date is reached. If a Ticket is not going to be used before it expires, it is your responsibility to contact PRT’s Customer Service Department to request a refund as further set forth in Section XII herein.

Your Ticket will be sold to you through PRT’s vendor, Masabi.

B.    Stored Value on Tokens

In addition to the option of purchasing Tickets on the App as described herein, you also have the option of adding monetary value that is represented in digital form on the App for future use of PRT Services (“Stored Value”). This pre-paid Stored Value can be loaded to your Account in any of the following ways:

(1) payment by a valid debit or credit card via the App;

(2) cash payment via PRT-approved retail outlets;

(3) debit or credit card at select PRT-approved outlets;

(4) cash at InComm/Vanilla Direct retail outlets; and

(5) PRT Fare Vending Machines.

Stored Value will be displayed in the “Account Balance” section of the App.  PRT is not responsible for your mobile device functionality or display condition, including lack of power to display the proper information for proper payment of fares. 

To use Stored Value for reduced fares on the App, you must be eligible for reduced fares.  For more information on reduced fares, please visit www.rideprt.org, click the “Fares” tab, and then click the “Discounted Fares” tab or contact PRT’s Customer Service Department during its normal operating hours at 412.442.2000.

ReadyFare™ Cards can also be used to pay fares with Stored Value and are available at PRT Fare Vending Machines and PRT designated retail sales outlet locations (subject to change).  PRT is not responsible for the availability of retail sales outlet locations, including business operations, hours and locations or the availability of ReadyFare™ Cards at the retail sales outlet locations. Outlet locations are not staffed with PRT employees and have no direct affiliation with PRT; therefore, PRT is not responsible for any actions of outlet locations’ employees or agents or events that may occur while you are present at outlet locations.  Participating outlet locations can be found on PRT’s website and are subject to change so you should check PRT’s website regularly to remain up to date on PRT-approved retail sales outlet locations.

PLEASE NOTE that the ability to register for and use Stored Value for half-fare rides via the App is provided through PRT’s Downtown Service Center. If a customer chooses to use the App for the purchase and use of Stored Value for half-fare rides and already has a Half Fare ReadyFare™ Card, the user’s Half Fare ReadyFare™ Card will be deactivated through the Service Center and replaced in the App with half fare eligibility activated.  Eligible customers can only have one type of half fare Token activated at any one period of time.

A fee of $1.00 will be applied to any transaction where a ReadyFare™ Card is issued. This fee is subject to change in PRT’s sole and exclusive discretion.   

A minimum single Stored Value transaction amount of $1.00 must be loaded to your Account, with a maximum single Stored Value transaction amount of $100.00 (amounts are subject to change). 

Any total Stored Value loaded to your Account may include third party card processing or related fees (where applicable).

For Stored Value purchased with a credit or debit card, the appropriate payment will be deducted from your bank or credit card account at time of purchase. (Please note that if you make Stored Value purchases via your credit or debit card, you may choose to store debit/credit card information in the App for future transactions.) 

C.    Token Validation

The security of your Tokens is your responsibility. PRT assumes no responsibility for any damaged, lost, or stolen mobile device(s) or ReadyFare™ Card(s).

Please ensure that you have sufficient battery charge to show to the driver and/or validate your Token (mobile device or ReadyFare™ Card) via an onboard validation device.  PRT does not accept any liability for any loss you may incur in the event that you do not have sufficient battery life on your mobile device and/or your mobile device malfunctions. 

The appropriate balance must be loaded prior to boarding a transit vehicle.  Once you add Stored Value to your Account, a bar code will appear in the App.  There must be enough Stored Value in your Account to cover the cost of a fare; you cannot split payments between your Account and cash or a credit card or a Ticket. Please allow time for the App to load while waiting for the bus, light rail or incline. If you are unable to display the applicable barcode on your mobile device, the full cash fare must be paid. No refund will be given by PRT.

You may be asked to show your Token and/or the applicable bar code associated with Stored Value to the PRT vehicle operator, a Port Authority Police Officer, and/or other designated PRT employees. 

PRT reserve the right to refuse travel paid via invalid Tokens or if used on a stolen mobile device or ReadyFare™ Card. Tokens are not transferable and may only be used by you and may not be shared. Tokens do not give you priority to use PRT Services over other passengers; PRT Services remain subject at all times to PRT’s vehicle capacity and service capacity.

If using a mobile Token, the barcode must be displayed clearly on the mobile device to the operator or validator every time you board a PRT bus or light rail vehicle, or when requested by a Port Authority Police Officer and/or other designated PRT employees.  The barcode must be retained during your entire trip on a PRT vehicle.

If a ReadyFare™ Card has been damaged or is not readable in any way to activate your Stored Value, it becomes invalid, and a new one must be purchased.

If you delete the App, you will also delete your Tickets and Stored Value from the mobile device. If you reinstall the App on the same mobile device it was deleted from, you should be able to display your Ticket and Stored Value.  You cannot print or transfer Tickets or Stored Value to another user.  Please also note that to be able to use the App, you may only change mobile devices three (3) times in a six-month period.

Your Stored Value will be issued to you via PRT’s vendor, Masabi.

PRT is not responsible for any refunds or credits as a result of card clashing. Card clashing happens when you accidently touch more than one ReadyFare™ Card on the payment reader at the same time. You must keep your ReadyFare™ Cards away from each other when utilizing the payment reader to ensure the correct fare is paid. The “correct fare” is defined as paying no more than the published PRT fare for your journey at the time of transaction(s). In order to pay the correct fare, you must also use the same Token (e.g., mobile device or ReadyFare™ Card), when paying a fare at the payment reader. PRT is not responsible for any refunds or credits as a result of your use or attempted use of multiple Tokens.

IV.             REGISTRATION OF ACCOUNT BASED TICKETING TOKENS

You may register multiple Tokens in your Account. Riders choosing to use a ReadyFare™ Card are not required to register and can remain anonymous; however, you will lose the ability for PRT to temporarily close your Account in the event of a lost or stolen ReadyFare™ Card, and you will not have the availability to accept other promotional offers and account benefits made through information gained during the registration process. Additionally, if you lose your ReadyFare™ card and it is registered, you can apply to PRT’s Downtown Service Center for a replacement. If you opt to utilize a mobile device as your Token to load and use Stored Value, you must first register it in your Account on the App.

If you register an Account with full access to your transaction history and other information, in addition to an email address, you may be required to provide certain other information (“Account Registration Data”). The following conditions will apply to all of your Account Registration Data:

●       You agree that the Account Registration Data provided by you is accurate, complete and will be kept up to date. Failure to do so will constitute a breach of these Terms and Conditions and may result in a termination of your Account and loss of access to the App without notice and at PRT’s sole and exclusive discretion.

●       You are responsible for maintaining the security and confidentiality of your Mobile Account user identification (“User ID”) and password. You are solely responsible for all activities that occur through the use of your User ID, password, and mobile device.

●       You shall not access or use or attempt to access or use the App using the identity or the Account Registration Data of any person other than your own.

●       You agree to immediately notify PRT of any unauthorized use of your User ID or password.

If you opt to utilize a ReadyFare™ Card, registration is available through PRT’s website as an alternative to registering via the App. When you choose to register through PRT’s website, you must also create an Account in the App with full access to your transaction history and other information, in addition to an email address, you may be required to provide certain other information (“ReadyFare™ Card Registration Data”) as well.

●       You agree that the ReadyFare™ Card Registration Data provided by you is accurate, complete and will be kept up to date. Failure to do so will constitute a breach of these Terms and may result in a termination of your account and access to the App without notice and at PRT’s sole and exclusive discretion.

●       You are responsible for maintaining the security and confidentiality of your Account user identification (“User ID”) and password. You are solely responsible for all activities that occur through the use of your User ID, password, and mobile device.

●       You shall not access or use or attempt to access or use the App using the identity or the ReadyFare™ Card Registration Data of any person other than your own.

●       You agree to immediately notify PRT of any unauthorized use of your User ID or password.

V.               SUMMARY OF AVAILABLE TRAVEL OPTIONS & UPDATES

A.                 Tickets

Travel is based on the cost of the applicable fare for PRT Services at the time of purchasing the subject Ticket. A Ticket is valid when it is activated on the mobile app after purchase. You may not start your trip on a PRT vehicle until you have a valid Ticket available. Once purchased, the Ticket will specify the fare type, the validity of the Ticket, and its expiration date.

PRT has the right, at its sole and exclusive discretion, to suspend access to Tickets on your mobile device for any reason, with or without notice. Except when PRT suspects fraudulent activity or believes that a rider is seeking to access Tickets other than in accordance with these Terms and Conditions, PRT will use reasonable efforts to only suspend access when carrying out maintenance on the App, or Masabi’s systems for supporting it, and to provide notice (where feasible) to affected users/riders.

PRT reserves the right to issue updates to the App, in which case you may not be able to continue use of the version of the App installed on your mobile device without downloading the latest update. PRT recommends that you download and install all updates issued. PRT is not responsible for errors which become apparent in old versions of the App.

B.              Account Based Ticketing

A Token can be used to purchase fares for all PRT fixed route bus, light rail and incline service. Travel is based on fare applicability on PRT Services at the time of boarding the service. You may not start your trip on a PRT vehicle until you have a valid Token and applicable fare available.

PRT has the right, at its sole and exclusive discretion, to suspend access to Stored Value in your Account at any time and for any reason, with or without notice. Except when PRT suspects fraudulent activity or believes that a rider is seeking to access or use the Account other than in accordance with these Terms and Conditions, PRT will use reasonable efforts to only suspend access when carrying out maintenance on the App, or Masabi’s systems for supporting it, and to provide notice (where feasible) to affected users/riders.

PRT reserves the right to issue updates to the App, in which case you may not be able to continue use of the version of the App installed on your mobile device without downloading the latest update.  PRT recommends that you download and install all updates issued. PRT is not responsible for errors which become apparent in old versions of the App.

VI.          DATA CHARGES

The App is free at this time, but data charges may be incurred to you by your mobile device network provider.  The App requires a correctly configured and functional wireless internet data connection for (i) the initial download and installation of the App onto a mobile device; (ii) the purchase of Tickets; (iii) periodic purchases of Stored Value through the App; and (iv) accessing updates on your account balance or account status.  You are solely responsible for any such costs. PRT will not take responsibility for any connectivity issues you may experience.  You do not need to have a functional wireless internet data connection in order to board vehicles.

VII.           TERMINATION OF ACCESS TO APP AND ACCOUNTS

If you violate these Terms and Conditions or any additional policies or guidelines posted on the App or for use of PRT’s Services, PRT has the right, in its sole and exclusive discretion, to immediately terminate your access to use the App and all access to Tickets and Stored Value in your Account.  PRT reserves all of its other rights at law and in equity.

VIII.         MATERIALS, OWNERSHIP AND RESTRICTIONS ON USE

The App is operated by PRT and is either owned by PRT or its third-party licensors (including without limitation Masabi) and any data, text, graphics, images, audio and video clips, logos, icons, software and links and any intellectual property and other rights relating thereto, are and will remain the property of PRT or Masabi or their respective licensors. You may not copy (other than copies made incidentally on your mobile devices in the course of your use of the App), reproduce, republish, upload, post, transmit or distribute the App or any of its content without the prior written permission of PRT and its licensors. Nor may you: (i) reverse engineer, decompile or seek to obtain the source code to the App except where and to the extent expressly required and as may be permitted by applicable law; or (ii) make or seek to make derivative works based on the App.

Use or downloading of the App is conditioned on acceptance of these Terms and Conditions. By downloading and/or using the App, you agree to remain knowledgeable of and agree to these Terms and Conditions. The App is supplied to you by PRT and neither Masabi nor any of PRT’s other third-party licensors have any liability to you arising out of or in connection with the App.

IX.             LIABILITY DISCLAIMER/INDEMNIFICATION/NO WAIVER OF IMMUNITY

In no event will PRT be liable for any direct, indirect, special, punitive, exemplary or consequential losses or damages of whatsoever kind arising out of your use or access to the App, including loss of profit or the like whether or not in the contemplation of the parties, whether based on breach of contract, tort (including negligence), product liability or otherwise.  In no event will Masabi be liable for any direct, indirect, special, punitive, exemplary or consequential losses or damages of whatsoever kind arising out of or in connection with your use or access to any Token or the App, including loss of profit or the like whether or not in the contemplation of the parties, whether based on breach of contract, tort (including negligence), product liability or otherwise.  Neither PRT nor Masabi or any other licensors relating to the App shall be liable for any damage or alteration to your equipment including but not limited to computer equipment or mobile device as a result of the installation or use of the App or any Token.

Representation and Warranty Disclaimer/Indemnification

PRT, ON BEHALF OF ITSELF AND PRT’S BOARD, INDIVIDUAL BOARD MEMBERS, OFFICERS, MANAGERS, EMPLOYEES, AGENTS AND ASSIGNS, EXPRESSLY DISCLAIMS ANY REPRESENTATION OR WARRANTY, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED OR EXPRESS WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR CONFORMITY WITH MODELS OR SAMPLES.

YOU AGREE TO INDEMNIFY AND HOLD PRT HARMLESS FROM AND AGAINST ANY AND ALL DAMAGE, LOSS, COST, EXPENSE OR LIABILITY RELATING TO, ARISING FROM OR AS A RESULT OF YOUR DOWNLOADING AND/OR USE OF THE APP.

No Waiver of Sovereign Immunity

Nothing in these Terms and Conditions or PRT’s sale or operation of the App or related fare media or public transit services through the App or PRT’s Services in general, shall be deemed or implied to be a waiver of PRT’s sovereign, governmental or other privileges or defenses available to PRT at law or equity. Rather, PRT expressly reserves the rights, privileges and immunities afforded to it as a government agency and agency and arm of the Commonwealth of Pennsylvania organized and existing pursuant to the Second Class County Port Authority Act, as amended.

X.               LEGAL RESPONSIBILITY/LOST MOBILE DEVICE/CESSATION OF SERVICE

These Terms and Conditions (as may be amended, updated, or supplemented from time to time) are intended by PRT to set out the entire agreement between PRT and you with respect to your use of, and the provision by PRT, of the App. PRT recommends that you read these Terms and Conditions carefully and remain knowledgeable of them and any update to them to protect your own interests and to ensure that you understand your rights and obligations hereunder. The use of the App and any transactions made through the mechanisms described herein are governed by the laws in force in the Commonwealth of Pennsylvania and the United States of America. You agree and submit to the exclusive personal jurisdiction and venue of the courts located in Allegheny County, Pennsylvania. The United Nations Convention on Contracts for the International Sale of Goods or laws of other states or territories outside of the Commonwealth of Pennsylvania shall not apply.

If you lose your mobile device with a valid Ticket or Stored Value saved on it, please call PRT’s Customer Service Department at 412-442-2000 where you can request that any Tokens associated with your Account be blocked. If registered, any Tickets or Stored Value remaining on your Account can be transferred to a new mobile device.

PRT may cease to operate the App or PRT’s Services at any time, in whole or in part and at PRT’s sole and exclusive discretion, in which case the values of any Tickets or balance associated with unused Stored Value at that time will be refunded, limited to the extent permitted by applicable law.

XI.             PRIVACY AND DATA COLLECTION

When utilizing the App on your mobile device or a registered ReadyFare™ Card, you acknowledge and agree that both PRT and Masabi will collect and store certain personal information about you and your travel using PRT’s Services including, but not limited to: 

·        Name 

·        Zip Code 

·        Payment history (including your debit and/or credit card details) 

·        Travel history on PRT’s Services (up to six months)

The collection, use, and privacy of information obtained from customers using the App are subject to PRT's Privacy Statement, as amended. The Privacy Statement is posted on the PRT website at www.rideprt.org/privacy policy.

PRT may use the information it collects from your download and usage of the App for management and promotion of the ReadyFare™ Program, PRT’s public transit operations and fare media, policy, and structure. In order to make the App available to you, PRT will also need to share your information with some of our third-party service providers, including but not necessarily limited to Masabi, credit card payment processing agencies, and financial institutions. These parties may also need to collect certain financial and other additional information about you.[KP1] 

Except as set forth herein, PRT will not sell or disclose your information for any other purpose without your written consent, unless there is a legal requirement (such as a statute, court order or lawfully issued warrant or subpoena for such disclosure). PRT may release or use personal information in connection with (a) legal proceedings or contemplated legal proceedings that directly relate to such information, including but not limited to instances of fraud or suspected fraud and/or misuse of the App; or (b) in response to a warrant, subpoena or court order specifically requesting such information. In cases involving threat of imminent harm to you or others, PRT may also release such information to prevent or mitigate the threat. In any such case, PRT will seek to limit the scope of the disclosure and restrict such disclosures only to appropriate authorities and will disclose only such personal information as is reasonably required to fulfill the purpose of the disclosure, at PRT’s sole, reasonable discretion.

XII.           CHANGES, REFUNDS AND PASS EXPIRATION

All refund requests will be reviewed on a case-by-case basis.  Tickets can be refunded by contacting PRT’s Customer Service Department at 412-442-2000 if they have not been used and have not expired. Partially used Tickets (e.g., multi-day passes) cannot be changed, cancelled, or refunded except in extraordinary circumstances.  Riders seeking change, cancellation or refund on partially used Tickets must present their request in person at PRT’s Downtown Service Center currently located at 623 Smithfield Street, Pittsburgh, PA 15222 during normal operating hours. PRT reserves the right and ability to correct the Account balance on your applicable Token (i.e., mobile device or ReadyFare™ Card) if PRT believes that a technical or accounting error has occurred. The decision to change, cancel or refund a Ticket or Stored Value is made at PRT’s sole and exclusive discretion. PRT employees are not permitted and will not provide a cash reimbursement in any circumstances. Neither PRT nor Masabi shall be obliged to change, cancel, replace, or refund a Ticket where PRT has reason to believe that the circumstances prompting the change, cancellation, replacement, or refund is the result of fraud. In the event that PRT believes that the circumstances prompting the request for change, cancellation, replacement or refund is the result of fraud, PRT may refer the matter to the appropriate authorities for further investigation.

If you have any questions or problems with the App, please review the FAQs on PRT’s website at www.rideprt.org for answers to the most common questions PRT receives from its users. If that does not answer your questions, please contact PRT’s Customer Service Department at 412-442-2000.

XIV.    SEVERABILITY

The invalidity of any term or terms of these Terms and Conditions shall not affect any other terms herein, which shall remain in full force and effect.

XV.     MODIFICATION

PRT reserves its right to change these Terms and Conditions at any time without advance notice. If PRT decide to change its Terms and Conditions, PRT will post the new Terms and Conditions at its Downtown Service Center and on its web site as soon as possible.

XVI.    NO REPRESENTATIONS AS TO FUTURE FARE STRUCTURE OR FEES

Use of the App does not entitle you to a specific fare price or fare program and is subject to the nature and extent of PRT’s Services at the time of use. PRT reserves the right to increase fares and the cost and structure of fare programs and fare media and PRT Services made available to the general public in accordance with applicable law and PRT Board policy, in PRT’s sole and exclusive discretion.

XVII.   REGULATIONS

Your use of the App is subject to all applicable tariffs, terms, conditions, rules, regulations, policies and procedures.

XVIII.  FARE POLICY/STRUCTURE CONTROLS

To the extent that these Terms and Conditions are inconsistent with any portion of PRT’s Board-adopted Fare Policy/Fare Structure, the Fare Policy/Fare Structure is deemed controlling and takes precedence over these Terms and Conditions.

XIX.    NOTICE OF EFFECTIVE DATE

Effective Date of this version of PRT’s Terms and Conditions for the App:  December 9, 2024.
